Terms of Service

The Uninterrupted Life, LLC ("Arete," "we," "us," or "our") welcomes you. By downloading, accessing, or using the Arete mobile application (the "App") or related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms").

IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT USE THE SERVICE.

1. Medical & Wellness Disclaimer (Crucial)

Arete is not a healthcare provider. The Services, including mood tracking, habit formation, AI-generated insights, and community content, are for informational, educational, and self-improvement purposes only.

• No Medical Advice: Nothing in the App constitutes medical or psychological advice, diagnosis, or treatment.

• AI Limitations: The "Context Engine" (AI) generates insights based on patterns. These are probabilistic suggestions, not professional prescriptions.

• Emergency: If you are experiencing a medical emergency or mental health crisis, call 911 or your local emergency services immediately. Do not rely on Arete for crisis intervention.

2. Eligibility and Accounts

• Age: You must be at least 13 years old to use the Services (or the age of digital consent in your jurisdiction). If you are under 18, you represent that you have your parent or guardian’s permission to use the App.

• Account Security: You are responsible for maintaining the confidentiality of your login credentials (including Apple Sign-In). You are responsible for all activities that occur under your account.

• Truthful Data: You agree to provide accurate information when creating your Identity Tags and profile.

3. The Services

Arete is a holistic "Life OS" designed to unify habits, moods, and community. The Services include:

• Habit & Routine Tracking: Tools to define and track daily actions.

• Flow Mode: Immersive timers and audio guides.

• Mood Logging: Tracking subjective energy levels.

• The Agora: Community features to share progress with other users.

• The Context Engine: Algorithmic and AI analysis of your data.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time without notice or liability.

4. Subscriptions and Payments

• The Founding Circle: Certain users may access the App via a one-time "Founding Member" contribution. This grants lifetime access to features defined at the time of purchase.

• In-App Purchases: The App may offer subscriptions (e.g., "Arete Plus") purchased through the Apple App Store.

  • Billing: Payment is charged to your Apple ID account at confirmation of purchase.

  • Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

  • Management: You can manage or cancel subscriptions in your Apple ID Account Settings.

  • No Refunds: All billing is handled by Apple. We cannot issue refunds directly; you must contact Apple Support for refund requests.

• Price Changes: We reserve the right to change pricing for future subscriptions with reasonable notice.

5. User Conduct and Community Rules ("The Agora")

Because Arete includes community features, we strictly enforce the following rules to maintain our "Sanctuary" environment. Violating these rules may result in immediate account termination. You agree NOT to:

1. Harass or Bully: Post content that is defamatory, hateful, violent, harassing, or discriminatory.

2. Post Objectionable Content: Upload pornography, explicit content, or content promoting illegal acts.

3. Spam: Use the community for unauthorized advertising or solicitation.

4. Impersonate: Pretend to be another person or entity.

5. Harm the Platform: Attempt to reverse engineer, scrape, or disrupt the App’s infrastructure.

Apple UGC Requirement: We have zero tolerance for objectionable content. We reserve the right to remove any content and ban any user who violates these standards at our sole discretion. Users may report objectionable content or abusive users directly within the App.

6. Intellectual Property

• Our Content: The Arete App, including its design, "Modern Sanctuary" aesthetic, logos, code, and original content (e.g., "Mederi" library), is owned by The Uninterrupted Life, LLC and is protected by copyright and trademark laws.

• Your Content: You retain ownership of your journal entries, mood logs, and personal data.

• License to Us: By entering data into Arete, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and analyze your data solely for the purpose of providing and improving the Services (e.g., to generate your AI insights). We do not sell your content to third parties.

7. AI and "Context Engine" Features

The App uses artificial intelligence to provide journal prompts and insights.

• Accuracy: AI technology is experimental and may produce inaccurate or "hallucinated" results. You should verify any advice generated by the AI before acting on it.

• Input: Do not enter sensitive personal information (like Social Security numbers or financial data) into the Journal/Context Engine.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE UNINTERRUPTED LIFE, LLC AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

1. Indirect Damages: Any indirect, incidental, special, consequential, or punitive damages (e.g., loss of data, loss of profits, emotional distress).

2. Service Interruptions: Any inability to access the App due to technical failures.

3. User Content: The conduct or content of other users.

4. Health Outcomes: Any injury or health issue resulting from your use of the Services.

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

9. Dispute Resolution

• Governing Law: These Terms are governed by the laws of the State of [Your State, e.g., Delaware/Wyoming/Texas], without regard to conflict of law principles.

• Arbitration: Any dispute arising under these Terms shall be resolved by binding arbitration on an individual basis. You waive the right to a trial by jury or to participate in a class action.

10. Termination

We reserve the right to suspend or terminate your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

11. Apple App Store Provisions

If you downloaded Arete from the Apple App Store, the following applies:

1. These Terms are between you and us, not Apple. Apple is not responsible for the App or its content.

2. Apple has no obligation to provide maintenance or support for the App.

3. In the event of any third-party claim that the App infringes their intellectual property, we (not Apple) are responsible for the investigation and discharge of such claim.

4. Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.
